Inicialmente, la prestación de servicios dependientes estuvo regida por el Derecho común, sin embargo, los valores de libertad e igualdad formales que lo inspiran desde fines del siglo XVIII condujeron en la práctica a una situación de explotación y miseria de los trabajadores. Por ello, fue necesario sustraer del derecho común la regulación del trabajo subordinado y construir un área que compensara la disparidad económica entre empleador y trabajador a través de la creación de un ordenamiento protector del contratante débil." |
